IMPORT PROCEDURES FOR BOTTLES, CAPS, CANS

Bottles are a type of container that holds liquid. They are characterized by a neck that is narrower than the body of the bottle and has a mouth to let the liquid in and out. They come in many different shapes and sizes. Bottles are usually made of glass or plastic. Bottles are imported from many different countries to Vietnam such as: Japan, China, Korea, Malaysia. Procedures for importing bottles, jars, caps, HS codes for plastic bottles, glass bottles, import tax, VAT and import policies for all types of bottles. 1. Bottle import policy

The procedures for importing bottles are specified in the following legal documents:

  • Circular 38/2015/TT-BTC dated March 25, 2015; amended and supplemented by 39/2018/TT-BTC dated April 20, 2018;
  • Decree 69/2018/ND-CP dated May 15, 2018;
  • Decree No. 15/2018/ND-CP dated February 2, 2018;
  • Decision No. 583/QD-TCHQ dated March 22, 2019.

According to the above legal documents, new bottles are not on the list of prohibited imports. Used bottles are on the list of prohibited imports and must have a license to import. When importing bottles, the import process is divided into two types:

  • Procedures for importing bottles used to contain food;
  • Procedures for importing unused bottles containing food.

For bottles containing food, it is necessary to self-declare food safety and hygiene. Therefore, it is necessary to declare the product before importing. Avoid the situation of storing and storing goods. Above are all the documents regulating the procedures for importing bottles. 2. HS code for bottles:

Looking up HS codes is a very important task when doing procedures to import bottles. HS codes are a series of numbers assigned to each specific item worldwide. HS codes between countries for an item are usually the same from at least the first 4 to 6 numbers. Therefore, when doing import procedures, you should refer to the HS code provided by the seller. Below are the HS codes of some types of bottles for your reference.

According to the import and export tax schedule, the HS code for bottles, jars, and caps is classified according to the material used to make the product. The import tax for bottles, jars, and caps ranges from 5% to 15%. This import tax rate is a preferential tax rate, in addition, there is a special preferential tax rate, usually 0%. The special preferential tax rate is applied to goods imported from countries and territories that have signed trade agreements with Vietnam. Determining the correct HS code is very important when carrying out import procedures for bottles, jars, and caps. Determining the wrong HS code will bring certain risks to you such as:

  • Penalty for declaring incorrect HS code according to Decree 128/2020/ND-CP;
  • In case of import tax, you will face a minimum fine of VND 2,000,000 and a maximum fine of 3 times the tax amount.

2. Import tax on bottles:

Import tax is an obligation that the importer must fulfill to the state. Import tax on bottles, jars, and caps has two types: import tax and import VAT. You can refer to the method of calculating import tax as below:

Import tax is determined by HS code, import tax is calculated according to the formula:

Import tax = CIF value x % tax rate

CIF value is determined by the ex-factory value of the goods plus all costs to bring the goods to the first port of entry in the importing country.

Import VAT is determined by the formula:

Value added tax = (CIF value + Import tax) x % VAT rate

According to the above calculations, it can be seen that the import tax of bottles and caps depends on the import tax rate. The import tax rate is determined by the HS code of the selected bottle and cap.

There are two types of import tax rates: preferential import tax rates and special preferential import tax rates. The special preferential tax rate is usually 0%, applied to goods imported from countries and territories with which Vietnam has signed trade agreements such as: China, Korea, Japan, Chile, Europe, Australia, India and ASEAN countries.

To be eligible for special preferential import tax rates, the shipment must have a certificate of origin, also known as ℅.

4. Documents for importing bottles:

Documents for import procedures for bottles in particular, and import procedures for other goods in general. Regulated in Circular 38/2015/TT-BTC dated March 25, 2015; amended and supplemented by Circular 39/2018/TT-BTC dated April 20, 2018.

  • Import customs declaration:
  • Bill of lading ;
  • Sales contract;
  • Commercial invoice;
  • Packing list;
  • Certificate of Origin (℅) – C/O;
  • Catalogs.

Above are all the documents in the import procedure file for bottles. The following documents are the most important: Customs declaration, bill of lading, commercial invoice. Other documents will be provided upon request from customs.

Certificate of origin is not a mandatory document. However, this is a very important document for importers to enjoy preferential import tax rates. Therefore, importers should negotiate and request the seller to provide a certificate of origin.

5. Procedures for importing bottles

The procedure for importing bottles and jars is the same as for many other items. It is very specifically regulated in Circular 38/2015/TT-BTC dated March 25, 2015, amended and supplemented by Circular 39/2018/TT-BTC dated April 20, 2018. We summarize the steps briefly so that you can visualize the whole picture. Below are the main steps for importing bottles of all kinds.

Step 1. Fill out customs declaration

After having all the import and export documents: Contract, commercial invoice, packing list, bill of lading, certificate of origin, notice of arrival and determining the HS code of the bottle. Then you can enter the declaration information into the customs system via the customs declaration software.

Step 2. Open customs declaration

After completing the customs declaration, the customs system will return the declaration classification results. If there is a declaration classification, print the declaration and bring the import documents to the customs office to open the declaration. Depending on the green, yellow, or red classification, follow the steps to open the declaration.

Step 3. Customs clearance

After checking the documents, if there are no questions, the customs officer will accept the declaration for clearance. You can now pay import tax on the customs declaration to clear the goods.

Step 4. Bring the goods home for storage and use

Customs clearance declaration then proceed to liquidate the declaration and do the necessary procedures to bring the goods to the warehouse.

6. Self-declaration of food safety for imported bottles:

According to Article 4 of Decree No. 15/2018/ND-CP dated February 2, 2018, bottles containing food must be declared food safety when imported and before being put on the market.

To make a food safety declaration for food containers, you need to do the following steps:

Step 1: Prepare documents

The food safety declaration dossier for food containers is stipulated in Article 7 of Decree No. 15/2018/ND-CP. The food safety declaration registration dossier for food containers will include:

  • Product announcement
  • Certificate of Free Sale or Certificate of Exportation or Health Certificate.
  • Food safety test results. Enterprises must register and test samples with competent agencies and centers of the Ministry of Health.
  • Certificate of food safety qualified facility.
  • Product catalog if available.

Note: All of the above must be in Vietnamese, if in English, it must be notarized translation.

Step 2: Food safety declaration

Food safety declaration for food containers is done on the national single window or by sending a paper dossier to the Ministry of Health. The time for receiving results for food safety declaration is 7 working days.

Step 3. Wait for feedback and supplement documents if any

The officer in charge will check the documents and respond to the request for additional documents if the documents are missing or incorrect. In case the documents are complete, the documents will be approved and confirmed for publication on the one-stop system.

Step 4. Receive announcement results

Above are the 4 basic steps for food safety declaration procedures for food containers. Food safety declaration procedures for food containers must be carried out before importing goods. Because the time for food safety declaration is very long, even lasting 30 days.
