To import African teak wood, businesses need to study two legal documents:

1 – CITES Convention issued with Circular No. 04/2017/TT-BNNPTNT dated February 24, 2017 of the Ministry of Agriculture and Rural Development, effective from April 10, 2017, replacing Circular 40/2013/BNNPTNT on the List of wild animals and plants in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora

2 – Appendix 03: HS code table for the List of objects subject to plant quarantine of Vietnam under Circular 24/2017/TT-BNNPTNT effective from January 1, 2018 replacing Decision No. 2515/QD-BNN-BVTV dated June 29, 2015

Before importing, the Enterprise needs to look up the scientific name of the type of wood that the Enterprise plans to import to see if it is included in the Appendices of the CITES Convention or not?

• In case the wood item is not included in the Appendices of the CITES Convention, the Enterprise can import this wood item without having to apply for a license from the CITES Authority of Vietnam.
• In case the wood item is in Appendix I of CITES Convention, the Company is not allowed to import this item.
• In case of wood products in Appendix II, III of CITES Convention, import must have a permit issued by the CITES authority of Vietnam.

Specifically, the Company's products are: Square-cut red wood (scientific name: Afzelia SPP) and roughly square-cut Tali ironwood (scientific name: Erythrophleum Ivorense) which are not included in the CITES inspection list, so when the goods arrive, the Company only needs to carry out plant quarantine according to the correct procedure.

The Hs code of Doussie red wood and Tali ironwood is: 44039990, import tax is 0%, VAT is 10%.

The most important document that the Enterprise must request the exporting unit to provide before the transaction is: Original Phytosanitary. Without the Phytosanitary, the Enterprise cannot carry out import procedures.

When goods arrive at Hai Phong or Ho Chi Minh port, businesses need to take the following steps:

1. Documents and procedures for plant quarantine when importing African ironwood:

Step 1: Create an account for your business on the national one-stop system at: https://vnsw.gov.vn/

Step 2: Upload quarantine documents including: Registration form according to the system form, attached Phytosanitary, Quarantine license if any, Bill, Contract, Invoice and Packing list. Wait for amendments and supplements until the application is approved.

Step 3: Prepare a hard copy of the application to submit:

• Contract, Invoice, Packing list, Bill: 1 copy
• Phytosanitary Certificate: 1 original

Step 4: Sample collection at the port

• Register for sampling at the port
• Wait for the quarantine results to be uploaded to the system and a hard copy of the quarantine results to be issued.
• Submit quarantine results to customs and continue with customs clearance procedures

1. Customs clearance documents for importing African ironwood include:

• Invoice, packing list: Copy (signed, stamped, title and unstamped: Certified copy)
• Bill (Bill of Lading): Original bill, or telex bill, surrender bill (copy)
• Ocean freight bill and CIC bill at Hai Phong and Cat Lai ports: in case of FOB price purchase
• Surcharge invoice at port of export: In case of purchase at Ex-works price
• According to experience in making wooden products, specifically: Go Do wood, Lim wood, importers often purchase goods under CNF, FOB, EXW or CIF Hai Phong, Ho Chi Minh conditions.
• Plant quarantine results
