PET FOOD IMPORT PROCEDURES

If your business is interested in pet food import procedures , you should not miss this article. Pets have become a trend for young people today, and imported pets from abroad are gradually being brought to the Vietnamese market for consumption. This means that imported pets must use imported pet food . However, in order to import pet food and complete customs procedures for this item, your business needs to know that pet food is under the management of the Ministry of Agriculture and Rural Development and must prepare procedures and documents such as: animal quarantine (for food products of animal origin), plant quarantine (for food of plant origin), quality control and circulation license. Let's go into the details with NP LOGISTICS below:
Legal basis:
Pursuant to Circular 25/2016/TT-BNNPTNT dated June 30, 2016 of the Ministry of Agriculture and Rural Development, animal feed of animal origin is subject to animal quarantine upon import.
Pursuant to Circular 30/2014/TT-BNNPTNT dated September 5, 2014 of the Ministry of Agriculture and Rural Development, animal feed of plant origin is subject to plant quarantine upon import.
Pursuant to Article 16 of Decree 39/2017/ND-CP and Circular No. 28/2017/TT-BNNPTNT dated December 25, 2017 of the Ministry of Agriculture and Rural Development promulgating the list of products and goods that are potentially unsafe under the management responsibility of the Ministry of Agriculture and Rural Development, imported goods such as animal feed are subject to quality inspection before customs clearance.

Pet food import procedures
Procedures for importing pet food are divided into two types: one is imported products that are already on the list of animal feed allowed to be imported into Vietnam, and the other is not yet on the list.

For imported dog and cat food, the product is already on the list of animal feed allowed to be imported into Vietnam. Each shipment imported into Vietnam must carry out the procedure of Registration for quality inspection and confirmation.
For imported dog and cat food that is not on the list of animal feed allowed to be imported into Vietnam, a circulation license must be obtained.

Appendix to Circulation License

Below, we go into detail about each type of document required to import pet food:
License for circulation of animal feed for dogs and cats:
For pet food products that are not on the list of animal feed products permitted for circulation in Vietnam according to Circular No. 02/2019/TT-BNNPTNT, when importing pet food to Vietnam, your business must register for circulation according to Decree No. 39/2017/ND-CP.
The application for a circulation license includes:

Application for registration of imported animal feed permitted for circulation in Vietnam
Consular legalized Certificate of Free Sale (CFS)
Copy of one of the following certificates: ISO, GMP, HACCP
Detailed product composition
Product label sample
Certificate of Testing Results of Product Quality and Safety Indicators (Certificate of Analysis)

The time to process the application and issue the certificate is within 20 days from the date the Department of Animal Husbandry receives the complete application from the Enterprise.
Pet food animal quarantine:
According to Decision No. 45/2005/QD-BNN issued by the Ministry of Agriculture and Rural Development on July 25, 2005, animal and poultry feed items under Section II are in the list of animals and animal products subject to quarantine. For animal quarantine, we will register while the goods are arriving at the port/airport.
Animal quarantine records include:

Health certificate (Animal quarantine certificate provided by the exporting country)
Quarantine registration dossier as prescribed in Clause 1, Article 45 of the Law on Veterinary Medicine
Bill of lading

The time to complete animal quarantine is 3 days. Dear businesses, please note that after completing animal quarantine, we can bring the goods to the warehouse to wait for the quality inspection certificate.

Veterinary Quarantine Registration Certificate

Quality control for dog and cat food.
According to Circular No. 66/2011/TT-BNNPTNT issued by the Ministry of Agriculture and Rural Development on October 10, 2011, Section 1, Article 10, Chapter III, regulations on quality inspection of imported pet food products of animal origin.
Quality control records include:

Sales contract
Packing List
Commercial Invoice
Certificate of Analysis of Quality issued by the country of origin for the shipment (Certificate of Analysis)

The Department of Animal Husbandry will verify and notify the Enterprise of the content, time and location of the inspection within 3 working days.
The time for issuing quality certificates is no more than 07 working days for mixed feed and raw materials for animal feed production.
Hs code and import tax of pet food:
Pet food has HS code under Part IV, Chapter 23
Part IV: PROCESSED FOODS; BEVERAGES, SPIRITS AND VINEGAR; TOBACCO AND PROCESSED TOBACCO SUBSTITUTES

Note:

Determining the HS code of functional food products must be based on the nature, composition, etc. of the actual imported goods. According to current regulations, the basis for applying the HS code to the actual imported goods at the time of import is based on the catalogue, technical documents (if any) or/and inspection at the Customs Inspection Department. The results of the actual inspection by customs and the results determined by the Customs Inspection Department are the legal basis for applying the code to the imported goods.
In the case of functional foods imported from countries with free trade agreements with Vietnam, they may enjoy special preferential import taxes if they meet the conditions set forth in the agreement. You should pay attention to this content to enjoy legal benefits on tax incentives. Currently, Vietnam has signed FTAs with over 50 countries, so it is likely that the items you import will enjoy special preferential import taxes.
