RICE EXPORT PROCEDURES

To understand this issue clearly, you need to read the following decree texts:

• Decree 109/2010/ND-CP: Rice export business
• Decree 107/2018/ND-CP: On Rice Export Business
• Circular 30/2018/TT-BCT: Guidance on Decree 107/2018/ND-CP on rice export business
• Document 02/VBHN-BCT(2018): Consolidating Circulars on rice export business (44/2010/TT-BCT; 28/2017/TT-BCT)

After carefully studying the above documents and decrees, before exporting rice we need to pay attention to the following two issues:

1st: Certificate of eligibility for rice export business:

To be certified as eligible to export rice, the following conditions are required:

1. Traders established and registered for business in accordance with the provisions of law are allowed to conduct rice export business when meeting the following conditions:

• There must be at least 01 specialized warehouse for storing rice and paddy in accordance with national technical standards and regulations on rice and paddy warehouses issued by competent authorities in accordance with the provisions of the Law on Technical Standards and Regulations.
• There must be at least 01 rice milling, grinding or processing facility that complies with national technical standards and regulations on warehouses and rice milling, grinding and processing facilities issued by competent authorities in accordance with the provisions of the Law on Technical Standards and Regulations.

2. Warehouses, milling, grinding and processing facilities for paddy and rice to meet the business conditions specified in Clause 1 of this Article may be owned by the trader or leased by the trader from another organization or individual, with a written lease contract in accordance with the provisions of law with a minimum lease term of 05 years.

A trader with a Certificate is not allowed to lease or sublease the warehouse, milling, grinding, or rice processing facility that has been declared to prove that it meets the business conditions in its application for a Certificate for another trader to use for the purpose of applying for a Certificate.

3. Traders who only export organic rice, parboiled rice, and micronutrient-fortified rice do not need to meet the business conditions specified in Point a, Point b, Clause 1, Clause 2 of this Article. They are allowed to export these types of rice without a Certificate, do not have to carry out the circulation reserve specified in Article 12, and are responsible for reporting according to the provisions in Clause 2, Article 24 of this Decree.

When carrying out export customs procedures, traders exporting organic rice, parboiled rice, and micronutrient-fortified rice without a Certificate only need to present to the Customs authority the original or a certified copy of the document confirming or certifying the competent agency or organization or the export rice appraisal certificate issued by the appraisal organization in accordance with the provisions of law on the conformity of the exported rice product with the criteria and methods of determination guided by the Ministry of Agriculture and Rural Development and the Ministry of Health in accordance with the provisions of Point d, Clause 2, Clause 3, Article 22 of this Decree.

However, it is possible to export in this way, which is to make an agreement with a company that has been granted a certificate of eligibility for rice export business and ask them to entrust you with the right to export. Thus, the company can still export rice.

2nd: Register rice export contract

Application for rice export contract registration includes:

• Application for registration of rice export contract
• Original or valid copy of signed rice export contract.
• Original report on available rice and paddy, stating the total amount of rice and paddy available in the trader's warehouse; specific address and amount of rice and paddy in each trader's warehouse.
• A valid copy of the Certificate of Eligibility for Rice Export Business (hereinafter referred to as the Certificate) when registering the contract for the first time.

So, once you have the above two things, the next thing is to just compile the documents and do customs procedures.

• Customs declaration, Contract, Invoice, Packing List
• Certificate of eligibility for rice export business or a contract of entrustment between the company needing to export and a company that is eligible for rice export business.
