Hot Service Update 2024: Import Procedures for Various Types of Lithium Batteries

Lithium batteries are a type of battery that uses lithium-ion (Li-ion) or lithium-polymer (Li-Po) technology to store and deliver energy. They are one of the most common types of batteries and are widely used in many mobile devices and electronic systems, including mobile phones, laptops, tablets, cameras, flashlights, game consoles, electric vehicles, and many other devices.

Door to Door Vietnam would like to introduce the following import process to our valued customers:

LITHIUM BATTERY IMPORT POLICY

The procedures for importing Lithium batteries are regulated by the following legal documents:

Value Added Tax Law No. 13/2008/QH12 dated June 3, 2008;
Decision 04/2017/QD-TTg dated March 9, 2017;
Circular 38/2015/TT-BTC dated March 25, 2015; amended and supplemented by Circular 39/2018/TT-BTC dated April 20, 2018;
Decree 69/2018/ND-CP dated May 15, 2018;
Decree No. 43/2017/ND-CP dated April 14, 2017;
Decree 128/2020/ND-CP dated October 19, 2020;
Circular No. 2/2022/TT-BTTTT dated May 16, 2022.

According to the above legal documents, lithium batteries are not on the list of prohibited imports. However, when going through import procedures, the following must be done:

Used lithium batteries are on the list of prohibited imports.
When importing goods, they must be labeled in accordance with Decree 43/2017/ND-CP.
Identifying the correct HS code is crucial for determining the correct tax and avoiding penalties.
Lithium batteries for laptops, mobile phones, and tablets must undergo quality control checks upon import.
