Import procedures for production lines

Import policy for production lines

The procedures for importing new production lines are stipulated in the following legal documents.

• Circular 23/2015/TT-BKHCN dated November 13, 2015,
• Circular 103/2015/TT-BTC dated July 1, 2015,
• Circular 38/2015/TT-BTC dated March 25, 2015, amended and supplemented by Circular 39/2018/TT-BTC dated April 20, 2018
• Decree No. 69/2018/ND-CP dated May 15, 2018
• Decree No. 43/2017/ND-CP dated April 14, 2017,
• Decision 18/2019/QD-TTg dated April 19, 2019
• Decree 128/2020/ND-CP dated October 19, 2020.

According to the above documents, the production line is not on the list of prohibited imported goods. However, when carrying out import procedures for the production line, the following points should be noted:

• A production line is a combination of many machines and equipment, therefore the HS code needs to be accurately determined.
• For used production lines, a certificate of inspection confirming the year of manufacture from the exporting country is required.
• Freestanding machines must have complete and regulated markings.
• In some cases, importers are required to have their goods inspected simultaneously as per customs regulations.
