COMESA Competition Commission in Africa investigates Maersk, CMA CGM and UAFL over freight rate violations
Three container shipping lines including Maersk, CMA CGM and United Africa Feeder Line (UAFL) are currently being investigated by the COMESA Competition Commission for possible violations of regulations on freight rates.

The COMESA Competition Commission in Africa announced that it has commenced an investigation, under Article 22 of the COMESA Competition Regulations, into potential violations of Articles 16 and 19 of the Regulations by three container carriers operating in The Common Market for East and South Africa (COMESA), consists of 21 African member countries.
In particular, the Commission has observed that Maersk of Denmark, CMA CGM of France and the German-controlled United Africa Feeder Line (UAFL) have issued price notices that may violate Article 16 of the Regulation.
The committee had initial concerns that the price announcement was a form of coordinated conduct or practice, according to a statement.
"Part 3 of the Regulations, particularly Article 16, prohibits all agreements which may affect trade between Member States and have as their object or effect the prevention, restriction or distortion of competition in the Common Market," the COMESA Competition Commission said in its announcement.
"Furthermore, Article 19 prohibits agreements or arrangements between competitors which, among others, allocate customers and markets within the Common Market. As such, the Commission will assess the extent to which the price announcements are compatible with the Regulations," the Commission concluded.
Accordingly, the Commission invites all interested stakeholders to submit representations on these allegations by 30 April 2022.
