Escalating Tensions: FMC Weighs Heavy Sanctions Against Spain for Blocking Israel-Linked US Vessels

The U.S. Federal Maritime Commission (FMC) has expanded its investigation and warned of severe sanctions, including fines of up to $2.3 million per voyage and vessel bans, against Spain due to its continued refusal of port access to U.S.-flagged vessels carrying cargo related to Israel.

The U.S. Federal Maritime Commission (FMC) has officially escalated its investigation into Spain's port access restrictions. The agency confirmed that Madrid continues to enforce a policy of denying entry to at least three U.S.-flagged vessels since November 2024, with these measures remaining in effect today.

This expanded investigation goes beyond the scope of the FMC's initial inquiry in December 2024. The focus has now shifted to Spain's persistent refusal to grant port access to vessels carrying cargo bound for or originating from Israel, and the broader implications of such actions on U.S. foreign commerce.

In its latest update, the Commission issued a firm assessment: “Based on the information obtained up to this point, it appears that the laws or regulations adopted, followed, or enforced by Spain are likely creating general or special conditions unfavorable to shipping in U.S. foreign trade.”


Weighing Heavy-Handed Retaliatory Measures


Given the situation, the FMC is currently considering potential enforcement actions. Scenarios currently on the table include:

•    Imposing cargo restrictions.

•    Denying entry to Spanish-flagged vessels at U.S. ports.

•    Fines of up to $2.3 million per voyage.


Origins of the Dispute


The investigation stems from serious incidents in November 2024, when Spanish authorities denied port calls to the Maersk Denver and Maersk Seletar. Both are U.S.-flagged vessels operated by Maersk Line, Limited, departing from New York. Notably, Maersk Line, Limited is a major and critical shipping service provider for the U.S. government and military.

However, the Commission emphasized that no final decision has been made and stated that any action will be guided by its statutory mandate and the evidentiary record collected.

The FMC has also opened this matter for public comment. Stakeholders are invited to submit information starting December 22, 2025, via the Federal Register.
